Montana is a non-judicial foreclosure state. Most home loans are foreclosed under the Small Tract Financing Act, where a trustee can sell the property without going to court — but the timeline is one of the more patient in the country, which usually works in your favor.
The trustee generally has to record and mail a notice of sale at least 120 days before the sale date, post it on the property, and publish it in a local newspaper. In most cases you can also reinstate — catch the loan up — any time before the sale, and Montana's Small Tract Financing Act generally does not allow a deficiency judgment, so the sale satisfies the debt. That long runway means there's usually real time to weigh your choices: reinstating, refinancing, a repayment plan with your lender, selling, or in some cases us taking over the payments.
